I General provisions
The Regulations set out the terms and conditions for booking and renting the Apartments posted on www.izbypodhalanskie.pl . Making a reservation is tantamount to reading and accepting the provisions of the Regulations. Making a reservation constitutes at the same time the conclusion of the Apartment Rental Agreement with the Customer, under the terms and conditions specified in the Regulations and the Price List. As part of the Rental Agreement, Izby Podhalańskie undertakes to prepare the Apartment and make it available to the Client in exchange for the agreed remuneration.
II Responsibility
We hereby inform you that, although our company makes every effort to continuously monitor and update the description of the Apartments' facilities, as well as to maintain their standard, it cannot be held responsible for changes over which we have no direct influence and/or control. In particular, for renovations, construction and finishing works in the vicinity of the Apartments, noise and temporary shortages in the supply of utilities. In addition, our company assumes no responsibility for personal belongings, the car and its contents, or for injuries or illnesses of the Client during his stay in the Apartment.
III Booking
Before making a reservation and entering into a rental agreement, the Client undertakes to familiarize himself with the content of these Regulations. Making a reservation is tantamount to accepting the Regulations. Reservations can be made using a data communications system. In this case, it is prohibited for the Client to provide content of an unlawful nature.
The current catalog of Apartments for short-term, tourist rental, along with their detailed description, can be found at www.izbypodhalanskie.pl.
Reservation of the Apartment can be made by the Customer in the following ways:
Booking an Apartment requires:
Submission of a reservation for the selected apartment in the reservation panel, located on the website www.izbypodhalanskie.pl in the RESERVE tab. Payment of a prepayment of 30% of the reservation value. The deposit should be paid directly through the reservation system via the reservation panel or by bank transfer to the bank account indicated in the form.
If you choose the option of self-transfer, the deposit should be paid within 2 working days from the moment of making the reservation. The reservation obtains the status "accepted" at the moment when the payment is credited. Lack of payment means withdrawal from the reservation and automatic cancellation of the reservation.
The client is obliged to pay the remaining 70% of the reservation value in accordance with the selected offer option and within the time period assigned to the offer. Non-refundable offers are non-refundable regardless of the circumstances. The rules for refunding the deposit paid may vary and are determined in each case at the time of booking. In case of any problems with the reservation or payment, the client should contact Izby Podhalańskie by phone (+48 787 388 110) or email (izbypodhalanskie@gmail.com). Izby Podhalańskie reserves the right not to admit persons who have grossly violated the Rules and Regulations during previous stays.
The photos, equipment and facilities of the Apartments and the prices quoted on the website are for informational, illustrative and advertising purposes only. The actual condition of the Apartment and its rental price is given in the form received after booking or in a telephone conversation.
IV Changes to the reservation
Any changes to the reservation are allowed only through the staff of Izby Podhalańskie. Changes may relate to the number of arriving guests or the dates of stay. The Client shall inform the Izby Podhalańskie by phone (+48 787 388 110) or email (izbypodhalanskie@gmail.com) of the extent of the changes they would like to make. Izby Podhalańskie reserve the right to refuse to make changes in the terms of the Reservation, if for objective reasons it will not be possible. In case of withdrawal from the Reservation due to the impossibility of making changes in the terms of the Reservation, the Client is not entitled to a refund of the deposit. Not using the Reservation or early departure of the Client from the Apartment, for reasons beyond the control of Izby Podhalańskie, does not entitle the Client to claim a refund of the fee for the unused stay.
Change and cancellation of reservation by Izby Podhalańskie
Reservation change by Izby Podhalańskie is possible only in the event of force majeure, preventing the fulfillment of the performance of Izby Podhalańskie. Force majeure is understood as: natural calamities, occupation of the apartment by any government authority for any purpose, strikes, wars and riots, and deprivation of electricity, gas, heating energy or water by the supplier of the apartment. In such cases, the Izby Podhalańskie is obliged to offer the Client another date or withdraw from the contract, refunding the Client the reservation fee paid (cancellation of the reservation).
In exceptional situations (failure in the Apartment or other fortuitous event), Izby Podhalańskie reserve the right to provide a replacement apartment with parameters and area similar to the reserved Apartment, in the same location. If the Client does not agree to the replacement Apartment, the agreement shall be terminated and the Izby Podhalańskie shall be obliged to return the reservation fee paid by the Client.
Izby Podhalańskie reserves the right to cancel without giving any reason the reservation within 24 hours of making it or in case of finding the fact of renting the premises for a purpose that does not comply with the regulations (e.g. organizing a party organized, 18th birthday party). In case of cancellation, the customer will receive a refund of all money paid.
V Rental Agreement
The contract concluded between Izby Podhalańskie covers only the rental of the Apartment. Access, meals and organization of the time of stay are the sole responsibility of the Client./p>
VI Rules of residence
Check-in at the apartment begins at 16:00 on the day of arrival and lasts until 11:00 on the day of departure.
The Client is obliged to inform Izby Podhalańskie by phone (+48 787 388 110) or e-mail (izbypodhalanskie@gmail.com) about the arrival time one day before the arrival date at the latest, in order to arrange the time of key pick-up. If the Client is unable to arrive at the pre-arranged time, he/she is obliged to immediately notify by phone (+48 787 388 110) the person responsible for handing over the keys.
The customer is obliged to report by phone (+48 787 388 110) any discrepancies or defects within one hour of receiving the keys to the apartment. All reports will be removed as quickly as possible by the employees of Izby Podhalańskie (max. within 24 hours of notification). In case of timely removal of non- compliance and defects, the customer has no right to any claims arising therefrom.
The Client is obliged to report by phone (+48 787 388 110) any defects arising during the residence in the apartment. The occurrence of a defect through the fault of the Client will incur an additional fee associated with its removal, according to the valuation of employees of the Izby Podhalańskie.
Loss of keys, parking card or remote control to enter the parking area involves an additional fee of 200 PLN.

The customer does not have the right to transfer the keys or make the apartment available to third parties. The guest is responsible for securing the apartment when leaving it (properly closing doors and windows).
It is forbidden to bring and use any devices that are not part of the equipment, powered by electricity or gas and that may pose a fire hazard, in particular: electric heaters, heaters, gas burners, flammable, explosive materials and materials with an unpleasant smell. During the residence, the number of persons staying overnight in the Apartment must not exceed the number of persons indicated in the application. In case of violation of this point, Izby Podhalańskie has the right to terminate the Agreement with immediate effect without any obligation to refund the amount due for the remaining period of reservation.
The customer is obliged to observe quiet hours at night (from 22:00 to 07:00). In the event of a legitimate complaint addressed to Izby Podhalańskie, the person representing the Izby Podhalańskie has the right to terminate the Agreement with immediate effect without any obligation to refund the amount due for the remaining period of the reservation. To determine the time of departure and return of keys, please contact by phone or email the day before the scheduled departure.
The Customer shall leave the Apartment in a condition not deteriorated from the condition in which he received it, and shall leave the dishes and kitchen appliances clean. If damage has occurred, the Customer is obliged to restore the previous condition or pay compensation - at the choice of the Podhale House. The object has the right to set a deposit for the residence in the amount of up to 2,500.00 PLN in the New Year's Eve period (i.e. for stays between December 27 and January 3) or for every other reservation.
The object does not agree to organize entertainment residences (birthdays, bachelor parties, hen parties) without prior approval of the object.
VII Smoking
Smoking is strictly prohibited in the Apartments.
VIII Pets
Dogs and other pets are strictly prohibited in the Apartments.
IX Payments and prices
All prices for services provided by Izby Podhalańskie are gross prices expressed in Polish zloty.
The fee paid by the Client includes charges for utilities (water, electricity, heating, Internet, cable TV).
If you wish to receive a VAT invoice for the residence, it is necessary to select the option "I want to receive an invoice" during the reservation and provide the data of the individual or company to whom the document is to be issued. If you do not provide details for a VAT invoice for a company during the reservation, it will not be possible to issue a document later.
X Personal data
Izby Podhalańskie informs that it processes personal data of Customers only for the purpose of fulfilling contractual obligations. The data will not be transferred or made available to third parties. The processing of personal data is in accordance with the legal regulations in force in Poland, i.e. the Law on Personal Data Protection and the Law on Provision of Electronic Services.
XI Complaints
The customer has the right to make a complaint about the service and assert claims on this account in accordance with the legal provisions in force in this regard.
The condition for consideration of a complaint is its submission to the e-mail address: izbypodhalanskie@gmail.com.
Properly reported complaints will be considered within 30 days from the date of their receipt. A response to the reported complaint will be sent to the Client at the postal address indicated by the Client.

Your personal data is processed for the following purposes:
to conclude and execute the contract for the provision of services by electronic means in accordance with the Regulations, including the processing of possible complaints, in the case of additionally expressed consent - also for the purpose of sending you marketing content, containing, in particular, information on information about promotions, services, contests, events and also for analytical and statistical purposes related to the sending of this content.
The legal basis for the processing of your personal data is: the necessity of their processing in order to conclude and perform the contract for the provision of services by electronic means (Article 6(1)(b) RODO), the Administrator's legitimate interest in handling your correspondence and the implementation of marketing activities ( 6(1)(f) RODO). Your personal data is stored for the period of your use of these services. After you stop using the services, your personal data in the following areas: name, surname, e-mail address will be kept for a further period of 3 years for the purpose of handling complaints and claims related to the use of these services.
If you request to stop sending marketing content, your personal data will be kept for a period of three years after receiving this request. Then your data will be kept only for the purpose of defending against possible claims related to this mailing.
You have the right to:
request access to your personal data, rectification, deletion or restriction of processing, as well as the right to data portability, object at any time to the processing of your personal data for the purpose of carrying out marketing activities, lodge a complaint to the supervisory authority, i.e. the President of the Office for Personal Data Protection.
Provision of personal data is voluntary, but it is a condition for the conclusion of the contract for the provision of electronic services. The consequence of not providing personal data is the Administrator's inability to provide services. Your personal data will not be used to make automated decisions, including profiling.
XIII Choice of law
Polish law is applicable to the execution of rights and obligations under the Agreement. If a dispute arises, it shall be settled by the court having jurisdiction over the seat of Izby Podhalańskie S.C.
